2. What Data We Collect

We only collect data that we genuinely need to provide our services. This primarily includes:

2.1 Contact Data

If you contact us via our contact form, by email, or by phone, we collect your name, contact details (email, phone), and the content of your message. We use this information exclusively to process your inquiry.

2.2 Customer Data in the Context of Our Brokerage Activities

For the brokerage of properties for sale and rent, we require further information such as search profiles, budget details, proof of financing, and – upon conclusion of a contract – proof of identity. We process this data based on legal requirements and to fulfill our contractual obligations.

2.3 Website Usage Data

When you visit our website, we collect technical data that your browser automatically transmits: IP address, pages visited, date and time of access, browser type, and operating system. This data is used exclusively for the technical operational security of our website.

3. Purpose of Data Processing

We process your data for the following purposes:— Processing your real estate inquiries and search profiles
— Coordination of viewings, negotiations, and contract conclusions
— Forwarding relevant data to third parties, insofar as this is necessary for contract fulfillment (e.g., notaries, banks, land registries, real estate portals)
— Sending our newsletter, provided you have given your explicit consent
— Compliance with legal due diligence obligations (e.g., Anti-Money Laundering Act AMLA)
— Improvement of our digital services and our website

The legal basis for processing is Art. 6 para. 1 lit. a (consent), lit. b (performance of a contract) and lit. c (legal obligation) of the GDPR, as well as the corresponding provisions of the Swiss DPA.

4. Disclosure of Data to Third Parties

BC Living is a franchise partner of REMAX Zollikon. As part of its network affiliation, data may be shared with the REMAX network, insofar as this is necessary for brokering a property.

Furthermore, your data will only be disclosed to third parties if necessary for the fulfillment of the contract – such as notaries, banks, authorities, or real estate portals (e.g., Homegate, ImmoScout24). Data will not be passed on for advertising purposes without your consent.

For the processing of your data, we use selected service providers (e.g., IT infrastructure, CRM systems). These are contractually obliged to maintain confidentiality and comply with data protection requirements.

5. Cookies and Tracking

Our website uses cookies – small data files stored on your device. We distinguish between technically necessary cookies (without which the website does not function correctly) and optional cookies for analysis and marketing purposes.

We only use optional cookies with your explicit consent. You can adjust your cookie settings at any time via your browser settings or withdraw your consent via the cookie banner on our website.

6. Data Retention

We store your data for as long as necessary for the respective purpose or as required by legal retention obligations. Customer data from completed transactions is generally retained for 10 years (according to Swiss accounting and tax law). Data from contact inquiries that did not lead to an order will be deleted no later than 24 months after the last contact.

7. Your Rights

Under applicable data protection law, you have the following rights:— Right to information about your stored personal data
— Right to rectification of inaccurate data
— Right to erasure (unless there is a legal retention obligation)
— Right to restriction of processing
— Right to data portability
— Right to object to processing based on legitimate interests
— Right to withdraw consent

To exercise one of these rights, please contact us in writing at: tino.brodar@bcliving.ch. We will process your request free of charge and without undue delay.

Should you believe that we are processing your data unlawfully, you have the right to lodge a complaint with the competent supervisory authority – the Federal Data Protection and Information Commissioner (FDPIC).

8. Data Security

We implement technical and organizational security measures to protect your data against unauthorized access, loss, or misuse. Our systems are regularly checked for security vulnerabilities. Your data is transmitted securely on our website via the HTTPS protocol.

Despite all due care, we cannot provide a complete guarantee for the absolute security of data transmission over the internet.

9. Updates to this Policy

We regularly revise this Privacy Policy to adapt it to legal developments and changes in our services. The current version can always be found on our website. We will inform you separately of any changes that significantly affect your rights.
